Terms of Service

The terms on which you may use NthCase. By creating an account or using the service, you agree to them.

The service

NthCase is operated by Unidots Software Solutions LLC, a Delaware limited liability company. It runs the tests you write against your apps, on devices in its device farm or on devices you connect yourself. How it handles data is described in the Privacy Policy.

Your account

You are responsible for what is done with your account and with your workspace's API keys. Keep your password and your keys to yourself, and revoke a key you think has leaked.

Test only what you may test

You may register and test only apps and websites you own, or that their owner has authorized you to test. The product asks you to confirm this for every app you register, in these words: “I own, or am authorized by the owner to test, this app or website.” It records who confirmed and when. Testing an app you are not authorized to test is prohibited.

Acceptable use

Do not use the service to attack, overload or disrupt systems you are not authorized to test, to get around their security, to send spam, or to store or send unlawful content. Do not try to break the service itself, get around its limits, or reach another customer's data.

Plans and credits

The plans, the credits each one includes and what operations cost in credits are the ones the product shows at the time. The credits a redemption code adds are top-up credits. Top-up credits are not refundable, and they do not survive archiving a workspace. These terms make no other promise about prices or refunds.

Your content

Your apps, scenarios, test results and the files you upload remain yours. You allow us to store and process them, and to pass them to the providers named in the Privacy Policy, as far as providing the service requires.

No warranty

The service is provided “as is” and “as available”. A test can miss a defect, or report a failure that is not one: results are an aid to your own judgment, not a guarantee about your app.

Limitation of liability

To the extent the law allows, Unidots Software Solutions LLC is not liable for indirect or consequential losses, lost profits or lost data arising from your use of the service.

Suspension

We may suspend or end access to the service for abuse, for a breach of these terms, or to protect the service or other people.

Changes to these terms

We may change these terms. When they change, the date at the top of this page changes with them, and using the service after that means you accept the new terms.

Assignment

We may assign or transfer these terms, and your account, to an affiliate or successor in connection with a merger, acquisition, reorganization or sale of assets; we will tell you before it takes effect. You may not assign them without our consent.

Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules.
